Terms of service
This document is an official public offer of FOP KITAIGOROD HANNA ARKADIIVNA, hereinafter referred to as the “Seller”, to conclude a contract for the purchase and sale of goods remotely through the HEVN brand online store, located on the website hevn.gallery, hereinafter referred to as the “Site”.
Placing an order on the Site means the Buyer’s full and unconditional acceptance of the terms of this public offer.
1. Terms
Seller — FOP KITAIGOROD HANNA ARKADIIVNA, which sells goods through the Site.
Buyer — an individual who places an order on the Site and/or purchases goods for personal use.
Goods — clothing, accessories and other goods of the HEVN brand, presented for sale on the Site.
Order — a properly executed request by the Buyer to purchase goods selected on the Site.
The Site is an online store of the HEVN brand, created on the Shopify platform and available at hevn.gallery.
2. General provisions
2.1. This public offer is an agreement of accession and regulates the terms of purchase of goods through the Site.
2.2. The Seller has the right to change the terms of this offer unilaterally. The current version of the offer is posted on the Site and is valid from the moment of its publication.
2.3. By placing an order, the Buyer confirms that he has read the terms of this offer, prices, characteristics of the goods, terms of payment, delivery, exchange and return.
2.4. In case of disagreement with the terms of this offer, the Buyer must refrain from placing an order on the Site.
3. Subject of the agreement
3.1. The Seller undertakes to transfer to the Buyer the property of the goods selected and paid for by the Buyer on the Site, and the Buyer undertakes to pay for and accept the goods under the terms of this offer.
3.2. The assortment, price, size, color, composition, description and other characteristics of the product are indicated on the corresponding product page on the Site.
3.3. Photos of products on the Site may differ slightly from the actual appearance of the product due to the peculiarities of color reproduction by the Buyer's device screen, lighting during shooting or other technical factors.
3.4. The presence of the product on the Site does not guarantee its availability at the time of order confirmation if the product was simultaneously ordered by other buyers or there was a technical error in accounting for the balances.
4. Ordering
4.1. The Buyer places the order independently on the Site, filling in the necessary data for purchase and delivery.
4.2. The Buyer is responsible for the correctness of the specified contact details, recipient details and delivery information.
4.3. After placing the order, the Buyer receives an order confirmation to the specified e-mail and/or in another way provided by the functionality of the Site.
4.4. The Seller has the right to contact the Buyer to clarify the details of the order, payment or delivery.
4.5. In the event of the absence of goods or the inability to fulfill the order, the Seller shall notify the Buyer and offer a replacement, waiting for the goods to arrive or a refund.
5. Price and payment
5.1. Prices for goods are indicated on the Site in hryvnia.
5.2. Payment for the order is made online via the WayForPay payment service or by another method available on the Site at the time of placing the order.
5.3. The order is considered accepted for processing after successful payment, unless otherwise agreed between the Seller and the Buyer separately.
5.4. The Seller has the right to change the prices of goods unilaterally. The price change does not apply to already paid orders.
5.5. Promotional offers, promotional codes and discounts are not cumulative, unless otherwise expressly stated on the Site or in the terms of a specific promotion.
5.6. In the event of a technical error in the price of the goods, the Seller has the right to cancel the order and return the money paid to the Buyer.
6. Delivery
6.1. Delivery of orders within Ukraine is carried out by the Nova Poshta delivery service at the carrier's rates.
6.2. Orders within Ukraine are shipped within 2–5 business days after receipt of payment, unless another term is specified on the Site or separately agreed with the Buyer.
6.3. International delivery is carried out by available international delivery services at the rates of the relevant carrier.
6.4. International orders are shipped within 2–10 business days after receipt of payment, unless another term is specified on the Site or separately agreed with the Buyer.
6.5. Orders sent outside Ukraine are processed and shipped without taking into account taxes, duties, fees and other payments of the recipient's country. Payment of any additional customs duties, taxes, fees or other costs associated with the import of goods into the recipient's country is the responsibility of the Buyer.
6.6. The cost of delivery is paid by the Buyer in accordance with the carrier's tariffs, unless otherwise provided for in the terms of the promotion or this offer.
6.7. Free delivery is valid for orders in Ukraine for an amount of UAH 15,000 or more, unless otherwise specified on the Site or in the terms of a specific promotion.
6.8. The Seller is not responsible for delivery delays caused by the carrier's work, customs procedures, martial law, emergency circumstances, weather conditions, technical failures or other circumstances beyond the control of the Seller.
6.9. When receiving the order, the Buyer is obliged to check the integrity of the packaging, the conformity of the goods to the order, the presence of defects or damage.
6.10. In case of damage to the goods during delivery, the Buyer must record this in the department or with the carrier's representative and notify the Seller.
7. Exchange and return of goods
7.1. The Buyer has the right to exchange or return goods of proper quality within 14 calendar days, not counting the day of receipt of the goods, in accordance with the current legislation of Ukraine.
7.2. Exchange or return of goods of proper quality is possible provided that the goods have not been used, their commercial appearance, consumer properties, labels, tags, packaging and a document confirming payment have been preserved.
7.3. Goods with signs of use, damage, foreign odors, traces of cosmetics, washing, repair or changes in the original appearance are not subject to return or exchange.
7.4. Goods that, in accordance with the current legislation of Ukraine, are not subject to exchange or return are not subject to exchange or return.
7.5. To arrange a return or exchange, the Buyer must contact the Seller at the contacts specified on the Site and provide the order number, contact details, reason for the request and a photo of the product if necessary.
7.6. The cost of delivery when returning or exchanging goods of proper quality is paid by the Buyer, unless otherwise agreed with the Seller separately.
7.7. In the event that the Buyer receives goods of improper quality, the Seller shall exchange, refund or other settlement in accordance with the requirements of the current legislation of Ukraine.
7.8. The refund is made to the Buyer's bank card or account after the Seller receives and checks the returned goods.
7.9. The return of the goods is carried out by prior agreement with the Seller through the delivery service "Nova Poshta" to the following details:

7.10. Shipments without prior agreement with the Seller may not be accepted.
8. Rights and obligations of the Seller
8.1. The Seller undertakes to:
transfer the paid goods to the Buyer in accordance with the terms of the order;
provide the Buyer with the necessary information about the goods, payment, delivery, exchange and return;
process the Buyer's personal data in accordance with the requirements of the current legislation of Ukraine.
8.2. The Seller has the right to:
change the assortment, prices, terms of promotions and discounts on the Site;
refuse to process the order in case of unavailability of goods, incorrect Buyer data or inability to contact the Buyer;
cancel an unpaid order;
cancel the order in case of a technical error, incorrect price or unavailability of goods.
9. Rights and obligations of the Buyer
9.1. The Buyer undertakes to:
provide reliable data for placing and delivering the order;
pay for the order in a timely manner;
check the goods upon receipt;
comply with the terms of this offer.
9.2. The Buyer has the right to:
receive the goods in accordance with the placed and paid order;
receive information about the goods, payment, delivery, exchange and return;
contact the Seller with questions regarding the order, exchange or return;
exercise consumer rights in accordance with the current legislation of Ukraine.
10. Personal data
10.1. By placing an order on the Site, the Buyer consents to the processing of his personal data for the purpose of fulfilling the order, delivering the goods, making payment, communicating with the Buyer and complying with the requirements of the law.
10.2. Personal data may include: name, surname, phone number, e-mail, delivery address, recipient details and other information necessary to fulfill the order.
10.3. The Seller does not transfer the Buyer's personal data to third parties, except in cases where such transfer is necessary to fulfill the order, make delivery, make payment or is provided for by the legislation of Ukraine.
10.4. Certain personal data may be transferred to payment services, delivery services, Shopify and other technical services necessary for the operation of the Site and fulfilling the order.
11. Responsibility of the parties
11.1. The Parties are responsible for non-fulfillment or improper fulfillment of the terms of this offer in accordance with the current legislation of Ukraine.
11.2. The Seller is not responsible for delivery delays caused by the work of the carrier, actions of third parties, force majeure or incorrect data provided by the Buyer.
11.3. The Seller is not responsible for the inability to place an order or use the Site, if such inability is caused by technical failures, actions of providers, payment services, Shopify or other circumstances beyond the control of the Seller.
11.4. The Buyer is responsible for the accuracy of the information provided, necessary for the processing, payment and delivery of the order.
12. Force majeure
12.1. The Parties are exempt from liability for partial or complete failure to fulfill their obligations, if such performance was a result of force majeure circumstances.
12.2. Force majeure circumstances include, in particular, military actions, emergencies, fires, floods, strikes, decisions of state authorities, disruptions in the work of transport, postal services, banking systems, payment services, the Internet or other circumstances that the parties could not foresee or prevent.
13. Dispute resolution
13.1. All disputes and disagreements arising between the Seller and the Buyer shall be resolved through negotiations.
13.2. If the parties cannot reach an agreement through negotiations, the dispute shall be resolved in accordance with the current legislation of Ukraine.
